Terms & Conditions

1. Acceptance of Terms

By creating an account with OmniTrax Shipping & Logistics, using our website, or utilizing any of our freight forwarding, shipping, delivery, or logistics services, you agree to be bound by these Terms & Conditions. OmniTrax reserves the right to update or modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of any revised terms.

2. U.S. Shipping Address

Upon registration, customers are assigned a U.S. shipping address and unique customer identification number for the purpose of receiving and forwarding packages to Jamaica. The assigned address remains the property of OmniTrax and may only be used by customers whose accounts remain active and in good standing. Customers are responsible for ensuring that their name and OmniTrax customer number are accurately included on all shipments.

3. Prohibited Items

OmniTrax does not transport prohibited, restricted, hazardous, or illegal items. These include, but are not limited to: firearms, ammunition, and weapon components; explosives, flammable substances, and hazardous materials; illegal drugs or controlled substances; currency and negotiable instruments; counterfeit goods; live animals; and any item prohibited by Jamaican, U.S., or international law. OmniTrax reserves the right to refuse, return, surrender to authorities, or dispose of any prohibited shipment without compensation.

4. Customer Responsibilities

  • Ensuring the accuracy of all shipping information
  • Providing invoices or proof of purchase when requested
  • Complying with customs regulations
  • Verifying that imported goods are legal for entry into Jamaica
  • Paying all applicable shipping charges, customs duties, taxes, administrative fees, and delivery fees

Failure to provide accurate shipment information may result in delays, additional charges, customs penalties, or shipment refusal.

5. Customs Clearance

By using our services, customers authorize OmniTrax to act as their agent for customs clearance, transportation, and delivery. Customers agree to reimburse OmniTrax for customs duties and taxes, government administrative fees, brokerage and clearance charges, and any additional fees incurred on the customer's behalf. All shipments entering Jamaica may be inspected by customs authorities. OmniTrax is not responsible for delays, assessments, seizures, penalties, or damages arising from customs inspections or regulatory actions.

6. Shipping Delays

Delivery schedules are estimates only. We shall not be liable for delays resulting from weather conditions, airline or shipping line delays, customs processing, port congestion, public holidays, government actions, natural disasters, or events beyond our reasonable control.

7. Loss, Damage & Liability

OmniTrax's responsibility begins only after a shipment has been received and scanned into our network. We are not liable for packages lost before arrival at our U.S. warehouse, incorrect purchases, seller errors or fraudulent transactions, damage from inadequate packaging, manufacturer defects, or normal wear and concealed damage. Any claims for loss or damage must be submitted within seventy-two (72) hours of receipt. For uninsured shipments, OmniTrax's maximum liability shall not exceed USD $100 per shipment. Additional insurance may be arranged before the item is shipped.

8. High-Value Shipments

Customers must notify OmniTrax before shipping any item valued at USD $400 or more. Failure to declare high-value items may limit or void any claim for loss or damage. Proof of value may be required.

9. Claims Procedure

To submit a claim, customers must provide the tracking number, a description of the issue, photos of the package and contents (where applicable), and the original invoice or proof of purchase. OmniTrax reserves the right to investigate all claims before settlement. Approved claims may be settled through repair, replacement, shipping credit, or reimbursement at OmniTrax's discretion, subject to liability limits.

10. Storage & Unclaimed Packages

Customers are notified when shipments are available for collection. Packages remaining uncollected for more than thirty (30) days may attract storage charges per our published rates. OmniTrax reserves the right to dispose of, auction, or otherwise remove unclaimed shipments after reasonable notice.

11. Deliveries

Local delivery services are available within designated service areas. Islandwide delivery may be facilitated through third-party courier providers. Customers are responsible for all applicable delivery and courier charges. OmniTrax is not responsible for delays, losses, or damages occurring after shipments have been transferred to third-party delivery providers.

12. Returns & Refunds

Shipping charges, handling fees, customs charges, storage fees, and delivery fees are non-refundable once services have been provided. OmniTrax does not process merchant returns, refunds, or exchanges on behalf of customers. Where requested, OmniTrax may assist with returning items from the U.S. warehouse before export, subject to applicable service charges.

13. Oversized & Fragile Items

Large, fragile, or specialty items are transported at the customer's risk. OmniTrax may require customers to sign a waiver before accepting certain shipments, including televisions, monitors, glass items, artwork, or oversized electronics. Unless specifically insured, OmniTrax shall not be liable for damage to fragile items during transportation.

14. Limitation of Liability

Under no circumstances shall OmniTrax be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of its services. Any liability shall be limited to the amount expressly stated in these Terms & Conditions.
